Does the IRS Send a Levy Every Time They Want to Garnish My Wages
An IRS Levy on your wages, salary or other income for personal services, does not have to be served each time you are paid. Once the IRS levies your accounts, or garnishes your wages, the levy is in place, until the debt is paid.
An IRS payment plan, or applying for hardship status, are two ways, to stop wage garnishment and bank levies. Of course there is always BK.

Can the IRS Levy My Social Security Benefits, Because of Unfiled Taxes?
Yes. however, I am not sure how often the IRS uses this Notice
There is a CP 91 Notice, which is used to notify someone that the IRS is going to levy their Social Security Benefits.
The notice states that there is a balance due and is still unpaid. (Even if you didn't file, the IRS will prepare a Substitute Return, and file for you)
The notice goes on to say that the IRS intends to take up to 15% of your Social Security Benefits, and explains what steps the taxpayer needs to take, to prevent the collection actions.

My friend said I could be charged with fraud, because I haven't filed my taxes in 3 years, is this true?
I had to look this one up, to be sure I got the wording correct.
Yes, not only can you be charged with fraud, you can go to prison for not filing an income tax return, when required to do so.
The fraud can be either a civil or a criminal charge.
Civil fraud results in a penalty of 75% of the taxes owed.
Tax evasion, on the other hand, is considered a felony with a maximum prison sentence of five years and a maximum fine of $100K.
Filing a false return, can be considered a felony as well.
If you need to file past due returns, or file a 1040X, we can help you.

How Does the IRS Know That I Didn't File My Tax Return?
The IRS uses a computerized, cross check system, to match W-2s, 1099s and other financial institution’s reports, to determine if taxpayers have submitted a return, which matches the information turned into them.
First you must understand, that Employers turn this information into the IRS, so that their expenses can be documented. An employer can claim the wages of employees, as a business expense.
True, the “IRS Computer” is very busy, however, sooner or later, it will figure out that there is no return, on file, for a particular W2 or 1099.
That’s when the letters start going out. The IRS calls them “Notices”
You will get a series of these letters over a period of time. The time frame varies, based upon, how much the IRS calculates that you owe.
It is best to respond ASAP, because the penalties and interest accrues daily. You could end up owing more in penalties and interest, than your original tax bill!

The DOJ Has Indicted 56 Tax Preparers, With 25 Convictions , Since January 1, 2010
The IRS has visited more than 5,000 tax preparers this year since January 1, 2010, in an effort to ensure that competent and ethical tax professionals are available for taxpayers.
Of these 5,000 visits, the IRS has worked with the Department of Justice to bring about 56 Indictments and 25 Convictions, since January 1, 2010 (IR-2010-44, April 7, 2010)
In California, tax professionals MUST renew their registration every year, including a Bond. Yes, Tax professionals, even from the State of California, may be at a lost for a standard why of doing things. Example: While some tax schools require tax preparers to include the 1099-MISC with the tax return, others do not.
Another such example is, some tax schools require the tax preparer to include details for large line items, other schools do not.
Because the IRS has not had a particular standard, I can image they have received tax returns prepared in a number of different ways.
The IRS is planning to do more to protect the taxpayer. Tax preparers in all states will be notified of these changes in the coming future.

The IRS's Three Year Window for Tax Refunds on Unfiled Taxes
Taxpayers have only until April 15 to file past due tax returns and qualify for an actual refund.
Past due tax returns are best filed ASAP. However, when you fail to file within the three year window, from the date the return was actually due, you can loose the actual refund check.
The IRS, usually will contact a taxpayer, in the form of a letter, when report income, suggest that the taxpayer may owe the IRS. If you have not filed your tax returns, and you have not heard from the IRS, that may be an indication that you may have a refund coming.

IRS Redesigning Notices Sent to Taxpayers
In an effort to communicate more effectively with taxpayers, the IRS has redesigning notices.
The newly formatted notices includes every day English and states what action the taxpayer should take.
The design is said to include a clear, simple and clean design.
Hopefully the new design will reduce the enormous amount of fear that many taxpayers experienced when opening the old notices.
You know, there is more to this “hope” stuff than I realized, cause “faith” surely, didn’t get the notices redesigned, or did it?

Report from the National Taxpayer Advocate, Says the Only 64% of Taxpayers, Get Through to the IRS When Calling
National Taxpayer Advocate, Nina E. Olson in her annual report to Congress, released the following information:
"According to Olson's report, the IRS only plans to answer 71 percent of the calls it gets this year. That's barely above the 69 percent level in 1998 when Congress got so fed up with complaints about taxpayer service that it reformed the agency. And the numbers have gone down in recent years – during the 2009 tax filing season, only 64 percent of callers got through."
Tax professionals have understood this issue for a long time, but not because we experienced the problem. The IRS provides a special number for tax professionals and has, in my experienced, been more that helpful and prompt in answer Tax professionals calls.
We know that it has been a problem, because, this is the reason, often times, that we get new clients.
When a taxpayer receives a letter from the IRS, the first thing many people do, is take a moment to contact the IRS. It is because the moment, turns into many moments, people get upset, and start looking for someone to help them.
If you receive communications from the IRS pertaining, to past due tax returns, you can seek out a local tax professional or even an online tax service, to help you resolve the issue as quickly as possible.
